[?] A summary of the violations found during the inspection are listed below.

3717-1-03.4(F)(1)(b) / Time/temperature controlled for safety food - cold holding.
Critical Repeat Observed garlic in oil mixture held on the cook cart holding 61F at the time of inspection despite a container stating keep refrigerated. In the state of Ohio mixtures of garlic and oil shall hold at 41F or below to prevent bacterial growth. All produce was discarded and the staff re-educated that garlic and oil mixtures must stay under temperature control.

3717-1-06.4(K) / Controlling pests.
Critical Repeat Observed fresh rodent droppings underneath the drive through soda machine and a build up of debris that indicates that the area had not been cleaned the night prior. FACILITY SHALL CONTROL PESTS TO PREVENT CONTAMINATION OF FOODS.

3717-1-02.4(A)(2) / PIC - Level Two Certified Manager
Repeat Observed that the manager has a serv safe certificate, but does not have state approval letter for it. The manager provided an email where he is scheduled to take the class with a health department in one week. At least one person shall have state approved level 2 food safety training.

3717-1-06.1(M) / Outer openings - protected.
Repeat Observed that the weather stripping on the rear kitchen door has not been repaired. Replace the weather sweep/strip to prevent pest entry. Outside light should not be visible from inside the facility.

3717-1-03.2(M) / Wiping cloths - use limitation.
Repeat Observed a wet rag left on the wok station for cleaning utensils. Once wiping cloths have been soiled or wet they shall be maintained in sanitizer between uses.

3717-1-05.4(N) / Covering receptacles.
Observed dumpster lids left open at the time of inspection. Dumpster lids shall be maintained shut when not in use to prevent attracting pests. The inspector closed the lids during the inspection.

3717-1-05.4(P) / Maintaining refuse areas and enclosures.
Repeat Observed bags of trash and boxes that were around the dumpsters. Maintain dumpster areas clean with all trash in the dumpsters to prevent attracting pests.

3717-1-05.4(O) / Using drain plugs.
Observed that the larger brown dumpster did not have a drain plug. Contact the dumpster company to have a drain plug inserted to the dumpster.

3717-1-06.4(B) / Cleaning - frequency and restrictions.
Repeat Observed nightly cleaning were insufficient to remove debris from under food prep areas. Clean thoroughly at night to prevent attracting pests.

At the time of inspection the facility had its pest control invoices from visits on 1/5 and 1/7. The pest operator noted a location behind the grill/fryers where activity was found and there are glue traps underneath the drive thru soda fountain where droppings are present. However, the facility has not correctly its prior violations.

At the time of inspection there was garlic and oil mixture out at room temperature despite this being discarded and discussed last time. At the time of inspection there was fresh mouse droppings underneath the drive through soda fountain area. It is evident that the area is not being cleaned nightly as it should be until the problem has been taken care of. There was food debris underneath the hot line and cook lines despite the inspector arriving at the opening.

Facility MUST do a better job of nightly cleaning and removing food debris to control the mice problem. Mice will not actively chase poison if other foods are available. Discussed expectations for the follow up.
