[?] A summary of the violations found during the inspection are listed below.

3717-1-02.4(A)(1) / Person in charge: assignment of responsibility.
Critical There was no person in charge present in the food facility during inspection. There must be a designated "person in charge" present during all hours of operation who is knowledgeable in aspects of food safety.
To minimize the risk of contamination, the license holder shall be the person responsible for the FSO or RFE, or may be the person in charge, or shall designate a person in charge and shall ensure that a person in charge with applicable knowledge is present during all hours of operation.
3717-1-06.4(K) / Controlling pests.
Critical Observed the presence of live insects, rodents, and other pests. Observed mice droppings on retail shelves-snacks area, dog food area, and back room by the wood pallets. Clean droppings and control pest.
To prevent illness, the presence of insects, rodents, and other pests shall be controlled by: Routinely inspecting incoming shipments of food and supplies; routinely inspecting the premises for evidence of pests; Using methods, if pests are found, such as trapping devices or pesticides used according section (C), (K) and (L) of rule 3717-1-07.1 of this code; and eliminating harborage conditions.

3717-1-06.1(M) / Outer openings - protected.
Observed an outer opening, window, or door without proper protection against the entry of insects and rodents. Light is shinning through the bottom of the back door. Seal against pest. A mouse only needs 1/4 inch to gain entry.
To prevent contamination, outer openings of an FSO or RFE shall be protected against the entry of insects and rodents as specified in this rule.
3717-1-06.3(D) / Distressed merchandise - segregation and location.
Observed damaged, spoiled, and/or recalled products that were not segregated from food, equipment, utensils, linens, and single-service and single-use articles. Observed dented cans on retail shelf : 3 cans of spaquettios, 1 can of mini ravioli, and 1 can of beefaroni. Damaged cans were removed from shelf during inspection.
To prevent contamination, products that are held by the license holder for credit, redemption, or return to the distributor, shall be segregated and held in designated areas that are separated from food, equipment, utensils, linens, and single-service and single-use articles.
901:3-4-15(B) / Embargoing of food due to adulteration, misbranding, or expired baby formula or baby foods
Repeat Food in an RFE must be embargoed due to adulteration, misbranding, or baby food or formula is expired. Observed expired baby food on retail shelf: 3 containers of puffs cereal snack banana. Food items were removed from shelf at time of inspection.
To prevent foodborne illness, whenever a licensor finds or has cause to believe within an RFE or FSO in their jurisdiction that any food is adulterated, or so misbranded as to be dangerous or fraudulent, or that infant formula, or baby food is expired, the licensor shall affix to the item a tag giving notice that the item is, or is suspected of being, adulterated, misbranded, or expired and has been embargoed.
