3717-1-03.1(A)(4)
Observed raw fish offered for human consumption that had not been properly frozen. Facility could not locate paperwork stating that fish being used for sushi was sushi grade.
Fish, other than molluscan shellfish, that are intended for consumption in their raw form, may be offered for sale or service if properly frozen for parasite destruction by the supplier or at the operation, and records are retained as required. Keep paperwork from fish distributor stating what parameters were met to insure that sushi fish has been frozen to eliminate parasites.

Miscellaneous sources of contamination observed. Observed the use of plastic"to-go" bags used to directly store frozen meats. Observed the use of cloth to wrap raw steaks in cooler. Observed numerous bulk bin scoops without handles.
Food shall be protected from contamination that is not specified under 3717-1-03.2 (A) to (X). Use only food grade storage bags to store and freeze food items. discontinue using cloth to wrap meat and other food items. Cloth is porous and can easily grow and support bacteria. Use only handled scoops to help prevent cross contamination.

Critical TCS foods were not being held at the proper temperature. Observed a prep cooler holding temperatures between 46-48F. (tofu, lettuce, and seaweed)
To prevent the growth of pathogens, except during preparation, cooking, or cooling, or when time is used as a public health control, TCS food shall be held at 135°F or above (except that roasts cooked using time and temperature parameters in 3717-1-03.3 may be held at 130° F), or at 41°F or less. Critical Refrigerated, ready-to-eat, TCS foods held refrigerated for more than 24 hours were not properly date marked. Observed no food items with date marks.
To prevent foodborne illness, refrigerated, ready-to-eat, TCS food held at a temperature of 41°F or less for more than 24 hours shall be clearly marked at the time of preparation or the time the original container is opened to indicate the date or day, that is a maximum of seven days, by which the food shall be consumed, sold, or discarded. Food equipment that is acceptable for use in a FSO or RFE shall be approved by a recognized food equipment testing agency. When homestyle equipment fails, it must be replaced with commercial grade, NSF approved items.

Observed an outer opening, window, or door without proper protection against the entry of insects and rodents. Observed a gap under back door large enough to permit rodents and insects to enter.
To prevent contamination, outer openings of an FSO or RFE shall be protected against the entry of insects and rodents as specified in this rule. Repair door/door threshold to deter pests.

The physical facilities shall be cleaned as often as necessary to keep them clean, and cleaning shall be done during periods when the least amount of food is exposed.
