Introduction

An unscheduled follow-up inspection to routine inspection #SHUN-DGEPTT was conducted. Areas of non-compliance identified at the last routine inspection were inspected for compliance.

Contraventions

Observed Violations
STAFFING: 12280 - CCLR s.34(4)(a) - Despite this section, during the half hour before a care program begins and the half hour after a care program ends, a licensee may permit children who would otherwise be grouped in different care programs, and who are arriving at or leaving the community care facility, to be grouped together and supervised other than as required under Schedule E if (a) the care program is described as Multi-Age Child Care, Group Child Care (Under 36 Months), Group Child Care (30 Months to School Age) or Group Child Care (School Age).
Observation: Upon discussion with the Manager, Licensing determined that, when there are more then 16 children in the group child care (30 months to SA) program, a child is moved from the program into the group child care (under 36 months) during the day. This is done due to a lack of staffing as there are only two staff in the GCC (30 months to SA) program.
Licensing discussed the importance of not mixing groups, that children need to remain in the program they are attending, and not moved into another care program as it hinders their development.
Additionally, Licensing discussed when allowed to mixed different care programs.
Corrective Action(s): A written response to be submitted to Licensing on how this contravention has been addressed.

CARE AND/OR SUPERVISION: 14030 - CCLR s.34(2)(b) - Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation: Upon discussion with the Manager, Licensing determined the following in two of the Group Child Care(under 36 months) programs;
- in room 2 the infant and toddler (I/T) staff opens and then an early childhood educator assistant (ECEA) works in the program. There is no ECE in the program.
- in room 1 there is no I/T staff in the morning until 1:30 PM. An ECE staff opens the classroom and works alone until another staff arrives.
- The Manager said that, in room 1, an I/T staff arrives at 1:30 PM however, Licensing was unable to confirm if the staff is an I/T staff as their certificate and file were not on site. Therefore, Licensing was unable to confirm that staff to child ratio was being maintained.
Licensing reviewed and provided clarification to the Manager on Schedule E and the importance of ensuring that staff to child ratio is met and maintained at all times.
This is a repeat contravention.
Corrective Action(s): A written response to be submitted to Licensing on how this contravention has been addressed.

RECORDS AND REPORTING: 19320 - CCLR s.59(a) - In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.
Observation: Licensing was unable to review one staff's file as it was not on site.
Licensing was unable to review any of the following required documents for one staff;
- certificate
- immunization status
- CRC
- first aid certificate
- work history
- references
- validation of certificate
Corrective Action(s): A written response to be submitted to Licensing on how this contravention has been addressed.

Comments

Summary of Inspection
At the follow-up inspection conducted today June 4, 2025 the Manager was present The Licensee has addressed some of the previously identified contraventions except the ones noted and discussed below and the ones identified in the contravention section. The Licensee is required to correct all identified non-compliances by the date indicated above in the violations section. A written response is to be provided to Licensing on or before June 5, 2025 for Licensing to review that appropriate corrective action has been taken to address all identified non-compliances.
The following contravention from routine inspection dated on May 6, 2024 is still outstanding;
- CCLR s.13(1) Licensing observed two carpets that are still curling at the corners in the group child care (under 36 months) classrooms. Licensing had received an email from the Director stating that this contravention had been addressed Licensing observed that it has not.
- CCLR s. 57(2)(d) Licensing observed that emergency contact information for one child has still not been observed. Licensing had received an email from the Director stating that this contravention had been addressed however, Licensing observed that it has not.

The following discussions were had
- having systems in place to ensure that staff records, and children's records are maintained
- self identification systems
- ensuring that aware of the facility's operations and staff are following the regulations
- staffing exemptions
- Schedule E and staff to child ratio

The contents of the inspection report were reviewed with the Manager at the time of the inspection and the Director after the inspection via telephone call. This report was written off site. A copy of this report was emailed to the facility.
