Comments
As stated in the May 28, 2021 Pool Inspection Report, Miami County Public Health (MCPH) contacted Ohio Department of Health (ODH) for proper guidance for the rope bridge and netting issue/violation observed at Tipp City Aquatic Activity Pool. The newest installation of rope bridge (that was not approved by MCPH) is an entrapment hazard under the netting connected to the special feature/play feature in the activity pool. Through inspection of two sided white netting on the rope bridge, the inspector observed the netting hanging loosely into the water. These two side nets can be pulled up to a height that will allow a person to slide under the netting structure and be trapped.

During a conference call on June 9, 2021, MCPH presented this issue/violation to ODH’s Recreation Program Administer (Mary Schaffer) through review of the past and present pictures and the last inspection report (May 28, 2021).
ODH’s Recreation Program Administer stated the all netting has to be reinstalled back to the manufacturer’s original specification as noted on past MCPH's pool inspection reports dated June 7, 2019, June 24, 2019 and May 28, 2021.

To be clear ODH and MCPH has determined that this rope bridge feature must be installed back to the original installation state to prevent any hazards. This means full netting must be secured to all netting attachment areas on poles or pillars or pool decking. As approved previously by the Ohio Department of Health.

Health Department files show the original installation was done by Astro Pool Company. This company will have the proper manufacture or original approval specification of the full netting to all metal pillars and pool structure. Furthermore, Health Department files (from the initial installation of the play feature netting) states that there cannot be more than a 4 inch gap between the netting and the pool concrete floor. As stated in previous pool inspection reports the current netting/rope bridge installation is in violation of the Ohio's Recreational Water Code sections:

3701-31-04 (B)(1) - Public swimming pool shall operate free of an imminent health hazard. This is a critical violation

and

3701-31-04 (B)(6)(z) - Special features are maintained in good repair and according to manufacturer specifications.
Observation (REPEAT): Special features were not maintained in good repair or in accordance with the manufacturer specifications. The netting on the special feature/play feature has a substantial gap present between netting and pool concrete floor which creates an entrapment hazard.
Correction: Replace the special feature netting/rope bridge in accordance with the manufacturer's specifications.

The following agreement was made to allow the pool to stay open until the proper installation of the rope netting is accomplished:
1. PIC (person in charge) is stationing a lifeguard on at the rope bridge area to continuously monitor this area at all time.
2. PIC understands that if the above condition (lifeguard at the proper station) is not met the entire activity pool will close due to the immediate health hazard.
