3717-1-02.4(A)(2) / Person in charge: assignment of responsibility.
Facility did not have one employee with supervisory and management responsibility and the authority to direct and control food preparation and service with level two certification in food protection. PIC does not have level 2 certification has purchased ServSafe online, but has not takent the proctored exam.
At least one employee that has supervisory and management responsibility and the authority to direct and control food preparation and service shall obtain the level two certification in food protection according to rule 3701-21-25 of the Administrative Code. Gave information on Proctored exam held on 6/20/17. Correct prior to second inspection.
3717-1-03.2(C) / Packaged and unpackaged food - preventing contamination by separation, packaging, and segregation
Critical Repeat Corrected During Inspection Observed food that was not properly protected from contamination by separation, packaging, and segregation. Observed raw eggs stored over bottled beverages in Beverage Air refrigerator in retail area of store.
To prevent contamination, food shall be protected from cross contamination by separating raw animal foods during storage, preparation, holding, and display from cooked ready-to-eat food as described in this rule. Instructed PIC to store eggs on bottom shelf, not above RTE foods/beverages.
3717-1-03.2(Q) / Food storage - preventing contamination from the premises.
Repeat Observed improper storage of food items. Observed oil and containers of flour sitting directly on floor. Containers holding flour still sitting on floor.
Food shall be protected from contamination by storing the food in a clean, dry location, where it is not exposed to splash, dust, or other contamination, and at least six inches above the floor. Store foods properly up off of the floor. Employee stating she will properly place a crate underneath food products. Correct By: 01-Jun-2017
3717-1-04.1(KK) / Food equipment - certification and classification.
Equipment is not approved by a recognized testing agency. Observed homeuse equipment throughout facility: Rival Crockpot (3), Avanti Black Microwave, Cuisinart food processor, Presto mini skillet, Kenmore freezer/fridge combo unit, Kitchen Aid handheld mixer (purple), and Kitchen Aid stand mixer (white).
Food equipment that is acceptable for use in a FSO or RFE shall be approved by a recognized food equipment testing agency. When and if these pieces of equipment no longer perform to satisfactory, replace with commercial grade. Any new equipment entering facility needs to be commercial grade.
3717-1-04.4(S)(1) / Single-service articles and single-use articles - use limitation.
Repeat Observed re-use of single-service or single-use articles. Observed multiple single use containers being re-used throughout facility (i.e. tart cherry container to store walnuts). Single use containers still being used for foods like applesauce and being stored under doughnut fryer in back room.
Single-service and single-use articles may not be reused. Instructed PIC to disconintue re-using single use containers obtain proper food grade durable containers. Correct By: 01-Jun-2017

3717-1-03.2(M)/Wiping cloths - use limitation.
Observed improper use and/or maintenance of wiping cloths. Observed wet wiping cloth sitting on table top.
(1) Cloths that are in use for wiping food spills from tableware and carry-out container that occur as food is being served shall be maintained dry and used for no other purpose; (2) Cloths that are in use for wiping counters and other equipment surfaces shall be: (a) held between uses in a chemical sanitizer of the appropriate concentration; and (b) shall be laundered daily; (3) Cloths that are used with raw animal foods shall be kept separate from cloths used for other purposes; (4) Dry wiping cloths and the chemical sanitizing solution in which wet wiping cloths are held between uses shall be free of food debris and visible soil; (5) Containers of chemical sanitizing solutions specified in paragraph (M)(2)(a) of this rule in which wet wiping cloths are held between uses shall be stored off the floor and used in a manner that prevents contamination of food, equipment, utensils, linens, single-service articles, or single-use articles; (6) Single-use disposable sanitizer wipes shall be used in accordance with EPA-approved manufacturer's label use instructions. 3717-1-03.5(C)(1)/Food labels - packaged food
A food packaged in the facility did not contain a label. Observed Barb's Chili in store area freezer without proper ingredients statement, weight and statement of responsibility.
Foods shall be labeled as specified in this rule. Instructed PIC to properly label Barb's Chili with ingredients, weight and a responsibility statement: name of facility & address (including city, state and zip code). Correct By: 01-Jun-2017
3717-1-04(A)/Multiuse utensils and food contact surfaces - material characteristics.
Equipment and/or utensils contain improper materials. Observed towels under drying equipment near 3-comp sink.
To prevent contamination, materials that are used in the contruction of utensils and food contact surfaces may not allow the migration of deleterious substances or impart colors, odors, or tastes to food and under normal use conditions shall be: Safe; durable, corrosion-resistant, and nonabsorbent; Sufficient in weight and thickness to withstand repeated warewashing; finished to have a smooth, easily cleanable surface; and resistant to pitting, chipping, crazing, scratching, scoring, distortion, and decomposition. Instructed PIC to discontinue using towels to store drying equipment/utensils. Correct By: 01-Jun-2017
3717-1-04.4(A)(1)/Equipment - good repair and proper adjustment.
Equipment and/or components are not maintained in good working order. Observed Beverage Air 3-door cooler in store to be leaking in 2 places and not holding proper temperature of 41*F or below when holding TCS foods.
Equipment shall be maintained in a state of repair and condition that meets the requirements specified under rules 3717-1-04 and 3717-1-04.1 of this code. Instructed PIC to repair or replace equipment. DO NOT STORE TCS FOODS INSIDE OF UNIT UNTIL REPAIRS HAVE BEEN MADE AND FUNCTIONING AT 41*F OR LESS. PIC stating they need to get a new piece of equipment due to age and use of current one. OK To store pop inside. Correct By: 01-Jun-2017

Observed accumulation of soil residue on nonfood-contact surfaces. Observed fan in cider pressing area of facility to contain an excessive amount of dust.

Observed accumulation of soil residue on nonfood-contact surfaces. Observed seals to deli case and in Beverage Air 3-door unit in store area to contain crumbs/dust/bugs and need cleaned.

Cleaned equipment and utensils, laundered linens, or single-service and single-use articles are not properly stored. Observed handles of utensils being stored down inside of container along with scoops with handles directly in product.
Cleaned equipment and utensils, laundered linens, single-service articles, and single-use articles shall be properly stored as described in this rule. Educated on proper utensil storage. PIC inverted utensils in container during inspection, ensure proper utensil storage for future. Correct By: 01-Jun-2017
3717-1-06.1(I)/Light bulbs - protective shielding.
Observed light bulbs or heat lamp that were not properly shielded or coated where required. Observed light shields in Beverage Air refrigerator to not be properly protected.
Light bulbs shall be shielded, coated, or otherwise shatter-resistant in areas where there is exposed food, clean equipment, utensils, or linens, or unwrapped single-service or single-use articles and does not apply in areas used only for storing food in unopened packages. An infrared or other heat lamp shall be protected against breakage by a shield surrounding and extending beyond the bulb so that only the face of the bulb is exposed. Instructed PIC to properly shield light bulbs in refrigerator. Correct By: 01-Jun-2017
3717-1-06.4(F)/Drying mops.
Observed mops being dried using an unapproved method. Observed mop sitting in bucket.
After use, mops shall be placed in a position that allows them to air-dry without soiling walls, equipment, or supplies. Instructed PIC to hang to air dry. PIC stating usually drying on hooks in facility. Correct By: 01-Jun-2017
3717-1-06.4(H)/Cleaning and maintenance of plumbing fixtures.
Observed plumbing fixtures that were not being kept clean and maintained. Observed 3-comp sink in cider pressing area of facility to be dirty and need cleaned prior to use.
Plumbing fixtures such as handwashing sinks, toilets, and urinals shall be cleaned as often as necessary to keep them clean and maintained. Instructed PIC to clean prior to use. Correct By: 01-Jun-2017
3717-1-06.4(L)/Removing dead or trapped birds, insects, rodents, and other pests.
Observed the presence of dead pests or insects. Observed dead bugs in light shield above prep table in kitchen area.
Dead or trapped birds, insects, rodents, and other pests shall be removed from control devices and the premises at a frequency that prevents their accumulation, decomposition, or the attraction of pests. Instructed PIC to remove bugs and clean out inside. Correct By: 01-Jun-2017

Equipment and/or utensils contain improper materials. Observed non food grade containers holding: flour, donut mix, iceing sugar and holiday donut mix. PIC has flour in original containers and has ordered food grade bags.
To prevent contamination, materials that are used in the contruction of utensils and food contact surfaces may not allow the migration of deleterious substances or impart colors, odors, or tastes to food and under normal use conditions shall be: Safe; durable, corrosion-resistant, and nonabsorbent; Sufficient in weight and thickness to withstand repeated warewashing; finished to have a smooth, easily cleanable surface; and resistant to pitting, chipping, crazing, scratching, scoring, distortion, and decomposition. Instructed PIC to obtain food grade containers, keep contents in original bag, or obtain food grade liners/bags so that food is not directly stored in contact with harsh chemicals from plastic container.
